This website is operated by Rodeo Marketplace LLC. Throughout the site, the terms “we”, “us” and “our” refer to Rodeo Marketplace LLC. Rodeo Marketplace LLC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

The Terms are a legally binding contract between you and Rodeo Marketplace LLC. Here forward Rodeo Marketplace LLC will be referred to as “Rodeo Marketplace.”

By accessing or using any part of the site, you agree to be bound by these Terms of Service, our privacy policy, anti-discrimination policy and all policies provided by Rodeo Marketplace. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Any new features or tools which are added to the current site shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Rodeo Marketplace may choose to temporarily change fees for services for promotional events (for example, no commission days) and such changes are effective when Rodeo Marketplace posts the temporary promotional event. It is your responsibility to check this page periodically for changes. Rodeo Marketplace may also designate any portion of our terms and conditions. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that Rodeo Marketplace is a vendor site. Each vendor has their own shop and policies. When you purchase from a vendor, you are agreeing to the polices set forth by the vendor as well as Rodeo Marketplace.

When making a purchase on Rodeo Marketplace, you agree to provide accurate information to the seller for payment and shipping.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by Rodeo Marketplace.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Rodeo Marketplace is not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of Rodeo Marketplace at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice.

Rodeo marketplace reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Rodeo Marketplace shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

Rodeo Marketplace provides vendors with many options to display as accurately as possible the colors and images of products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

Rodeo Marketplace reserves the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. Rodeo Marketplace reserves the right to limit the quantities of any products or services that are offered. All descriptions of products or product pricing are subject to change anytime without notice; at the sole discretion of Rodeo Marketplace. Rodeo Marketplace reserves the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.  All sales are “as is” condition.

Rodeo Marketplace does not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Rodeo Marketplace supports your copyright in accordance with general U.S. intellectual property laws, and the Digital Millennium Copyright Act. If you suspect copyright infringement, Rodeo Marketplace will disable the items in question, keeping both parties informed, including sharing the infringement details and counters, until resolved.

If you are suspected of copyright infringement, Rodeo Marketplace will notify you and provide the opportunity for a counter on the infringement. DMCA counter will allow the material to be reinstated after 10 days, unless the original infringement is pursued through the courts.

You will need to create an account with Rodeo Marketplace and agree to these terms, to use some of our Services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You are responsible for any and all account activity conducted on your account, including activity by a minor on your account.

Rodeo Marketplace supports minors who use this site, as long as they follow these additional criteria:

All purchases must be supervised and approved by, account owner, parent/legal guardian and use the parent/legal guardian’s payment account details.

While selling items, minors must disclose they are operating under the supervision of their parent/legal guardian and provide their names.

The minor must use their parent/legal guardian as the one responsible for financials.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to trademark and copyright laws).

If you are using our services for a business, by confirming your agreement to these terms, you affirm that you are making the agreement on behalf of the business.

With the same legal binding, you agree to receive electronic communications (billing, legal documents, information, any communication) from Rodeo Marketplace and you agree to use digital signatures, including checking a box for agreement. Should you choose to opt out of electronic communications, you must provide an accurate mailing address and you will be billed for the copies and postage. Rodeo Marketplace will not be responsible for lost or undeliverable mail.

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

Rodeo Marketplace reserves the right to terminate any account for any reason. Likewise, you may terminate your account for any reason. If you terminate your account, you are still responsible for completing any open customer transactions and paying any outstanding fees.  Account termination will result in a loss of all content.

Accounts are non-transferable.

Ensure your content does not violate copyrights and that you own the content you post.

Report any suspicious violations. Rodeo Marketplace reserves the right to remove any content.

Notify Rodeo Marketplace if your content is misused by another member. We will determine the appropriate next steps, up to termination of the abuser.

You grant us, royalty free, permission to use your content to promote your products and Rodeo Marketplace.

Agree to post according to our terms. Do not post false, misleading, illegal, offensive material or material not in line with our mission to promote rodeo.

Do not use links for websites outside of Rodeo Marketplace, unless part of your payment package.

Use the review system to accurately describe your review of the product or store. Do not abuse the review system and sabotage another member. Inaccurate reviews will be removed and if you are found to violate our policy on providing misleading, false, inaccurate, illegal, vulgar or disrespectful information, your account will be terminated.

Resolve disputes with other members cordially.

You are welcome to sell any item you wish, that relates to rodeo or the western lifestyle. You may choose to sell handmade items, used items, new items or sell items to promote your event. You may also sell your time as a bookable product. Your items must comply with our policy and not be misleading, false, inaccurate, vulgar, disrespectful or illegal. Please refer to our seller guide for additional requirements.

You will obtain any required licenses and or permits needed to operate your shop and sell corresponding items.

You will protect customer’s data and respect their privacy. You will not use customer data for any other purpose than payment and shipping as necessary for purchases.

You will ensure that handmade items or photos are made/taken by you, or you will disclose the original artist.

You will ensure that if you are selling new items that you have the manufacture’s approval for you to sell their items. This will be disclosed on your shop.

You will disclose if you are selling items to promote your event, including event details. You must be affiliated with the event to be selling their promotional items and/or have their consent, which will be disclosed on your shop.

You will ensure that the used gear is in working condition, accurately describing any wear and tear. Do not sell any defective, or severely worn gear. If you are found to sell unsafe, or defective gear, your account will be terminated and Rodeo Marketplace will not be held liable for any legal recourse against you, should any occur.

You will develop and honor your individual shop policies in line with Rodeo Marketplace’s policies. Your interactions with customers will be professional.

You will process any requests for returns or exchanges, per your policy. You will communicate timely, with the buyer any changes to their order, including cancellations, returns and/ or exchanges.

You will attempt to resolve any disputes with customers, always keeping the positive approach. If no resolve is eminent, you will involve Rodeo Marketplace and provide accurate, timely information. Rodeo Marketplace will review the dispute and determine next steps. Once you involve Rodeo Marketplace in the dispute, you are agreeing to the resolve set forth by Rodeo Marketplace. Rodeo Marketplace will abide by rules and regulations set forth by the state of California and the Federal Government.

You will not sabotage other Rodeo Marketplace members or their respective stores. This includes no harassment, abuse, misuse of store features, transaction meddling, or fraudulent purchases and reviews. If you are found in violation, your account will be terminated.

You are responsible for paying your fees incurred from Rodeo Marketplace. If your account is terminated, you are still responsible for paying your fees associated with your account.

Rodeo Marketplace will determine the level of tax to be collected from the buyer and remit individual states requirements as required for a marketplace facilitator. You, as the seller, are responsible for collecting this tax and reporting it appropriately if you sell outside of Rodeo Marketplace.

You will abide by the terms and conditions set forth in this policy as well as our privacy policy, using common sense and moral aptitude.

A buyer may request a refund directly from the seller if the product has not yet shipped. The seller must agree with the reason for refund. If both parties agree to refund, then the seller can request the refund. If the seller does not agree, or the product has shipped, the buyer can request a store credit from the site admin at [email protected]  

 

The admin will process your request for refund toward store credit under the following conditions:

  • The seller refuses to provide service or product, but the buyer has paid.
  • The item was shipped, provide proof from the seller, but the buyer did not receive the item and you have exhausted the shipping provider, providing proof.

 

A seller may cancel an order if any of the following conditions are met:

  • The seller and buyer agree to cancel the sale.
  • The buyer did not pay.

If the buyer and seller cannot come to terms and need assistance with processing a refund or cancellation, either party may request assistance at [email protected].

Under no circumstances will Rodeo Marketplace, or employees, be liable for any indirect, incidental, consequential or special damages (including lost profits) of any form incurred by any person, whether or not foreseeable and regardless of the form of the act in which such a claim may be brought to Rodeo Marketplace. Rodeo Marketplace’s products are sold by independent sellers, who understand that Rodeo Marketplace is a venue and does not provide any warranty on safety, services, or products.

Rodeo Marketplace holds no responsibility over the content posted by our members, or those visiting our site. Rodeo Marketplace will not be held liable for any inaccurate, offensive, or illegal information found on the site.

Rodeo Marketplace allows elite sellers to utilize coupons.  The seller hold full responsibility of managing the coupons and their limitations. Rodeo Marketplace is not responsible for inaccuracy on coupon advertising, or coupon use. The seller takes on all financial burden from coupon use.

Rodeo Marketplace does not control our third-party terms of use. Your use of their services are not covered under Rodeo Marketplace services or terms of use. Any information accessed through third-party information, including advertisements, is not affiliated with these terms and conditions.

By agreeing to these terms, you release Rodeo Marketplace from any claims brought against your store, services, products, or safety.

By using our site to make a purchase, you agree to hold Rodeo Marketplace harmless in any claims filed against sellers.

Rodeo Marketplace reserves the right to handle our legal obligations to meet our best interest.  As a user of Rodeo Marketplace, you agree to collaborate with us on any legal matters.  Rodeo Marketplace is based in California and governed by the laws of the state and federal as appropriate.  Any disputes with Rodeo Marketplace shall be submitted to confidential binding arbitration in the City of Alturas, California for the maximum judgment enforceable, except that to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the State of California. You and Rodeo Marketplace agree to submit to the personal and exclusive jurisdiction of the courts located within Modoc County California. You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of California. Arbitration under this Agreement shall be conducted pursuant to the existing Commercial Arbitration Rules at the American Arbitration Association. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim is initiated in court rather than in arbitration we each waive any right to a jury trial.
